Terms & Conditions

§1. General Provisions

1. These Terms and Conditions define the rules for using the online store available at www.glademcakes.pl, operated by [company name], with its registered office at [address], NIP: [Tax ID], REGON: [Business ID].
2. By placing an order, the Customer accepts the provisions of these Terms and Conditions.
3. The Terms and Conditions are available free of charge on the website and may be downloaded, saved, and reproduced.

§2. Placing Orders

1. All products offered are made to individual order, based on the specifications provided by the Customer.
2. The Customer is obliged to provide true and complete information necessary for fulfilling the order.
3. When placing an order, the Customer shall:
   • Choose a cake design and appearance appropriate for the event;
   • Define flavor preferences that will suit the majority of guests;
   • Select the appropriate size of the cake;
   • Provide details of the design: colors, inscriptions, decorations;
   • Assess their financial situation and make an informed purchase.

§3. Payment

1. Payment is made in full and in advance at the time the order is placed.
2. Order fulfillment begins only after the full payment is credited to the company’s account.

§4. No Order Cancellation or Refunds

1. In accordance with Article 38(3) of the Polish Consumer Rights Act of 30 May 2014, the Customer does not have the right to withdraw from a distance contract in the case of goods made to the consumer’s specifications or clearly personalized.
2. Orders are non-refundable and cannot be cancelled.

§5. Order Changes

1. Changes to an order (e.g., design, flavor, decorations) may be made no later than 7 calendar days before the scheduled completion date.
2. After this deadline, no changes to the order are possible.

§6. Force Majeure

1. In the event of unforeseen circumstances (e.g., natural disasters, accidents, power outages) that prevent fulfillment of the order, each case will be considered individually.
2. Gladem Cakes will make every effort to inform the Customer about any delays or changes.

§7. Pickup and Transport

1. Cakes must be transported responsibly:
   • Kept horizontal,
   • Transported in an air-conditioned vehicle,
   • Without tilting, shaking, or sudden movements.
2. Gladem Cakes is not responsible for any damage that occurs during transport carried out by the Customer.
3. The Customer is required to sign a pickup and transport instruction upon receiving the order.

§8. Allergen Information

1. Products may contain: gluten, eggs, milk (lactose), nuts, soy. – only for general/ ordinary cake (in dietary preferences).
2. Decorations may include non-edible components (e.g., floral wires, plastic/wooden sticks for supports, ribbons, fresh flowers) which must be removed before serving.
3. The Customer is responsible for informing Gladem Cakes about any allergies among event attendees.

§9. Complaints

1. Complaints regarding non-compliance of the product with the order must be submitted in writing within 24 hours of pickup.
2. Complaints will be considered individually. Complaints based on subjective taste preferences or aesthetic impressions will not be accepted.

§10. Intellectual Property

1. All cake designs created by Gladem Cakes, including images published on social media or the website, are the intellectual property of the company.
2. It is not permitted to copy, reproduce, or publish them without clearly crediting Gladem Cakes and obtaining prior written consent.

§11. Final Provisions

1. Gladem Cakes reserves the right to amend these Terms and Conditions. Any changes become effective upon being published on the website.
2. Matters not regulated herein are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.

In the event of discrepancies between the Polish and English versions of these Terms and Conditions, the Polish version shall prevail.
